GENERAL TERMS AND CONDITIONS OF SALE
1. Purpose and scope of application
These General Terms and Conditions of Sale (GTCS) govern the contractual relationship between Kaotiko SL and its adult customers regarding the purchase of products sold by Kaotiko through www.kaotikobcn.com and other applicable sales channels.
Placing an order implies acceptance of these General Terms and Conditions of Sale.
2. Placing orders
Orders can be placed through www.kaotikobcn.com, which is available 24 hours a day, every day of the year, except for interruptions necessary for maintenance or causes beyond Kaotiko's control.
Once the order is placed, the customer will receive a confirmation with the information corresponding to their purchase.
3. Prices
The prices published on the website are indicated in euros and include legally applicable taxes, unless expressly stated otherwise.
Kaotiko reserves the right to modify its prices, promotions, and offers. In any case, the price shown at the time of purchase will be applied to the order.
4. Shipping costs
Shipping costs depend on the destination country or area and will be shown to the customer before finalizing the order.
Collection in stores enabled for this service is free of charge.
Any applicable taxes, duties, or customs charges in certain destinations not included in the price will be the responsibility of the recipient where legally required.
5. Payment methods
The customer may use the payment methods available during the purchase process, including:
- Credit or debit card.
- PayPal.
- Klarna, when available.
- Other payment methods that may be enabled on the website.
The specific conditions of the payment service providers will apply where appropriate.
6. Shipping
Kaotiko ships to Spain, the Balearic Islands, Portugal, the Canary Islands, and other international destinations enabled on the website.
The delivery times, costs, and available methods will be shown during the purchase process and may vary depending on the destination and the transport service selected.
7. Right of withdrawal and returns
Kaotiko offers the customer a period of 30 calendar days to request a return of products, without prejudice to the minimum legal withdrawal period applicable.
To exercise the right of withdrawal, the customer must communicate their decision to Kaotiko through the enabled customer service channels and follow the instructions provided to make the return.
Products must be returned in the conditions required by applicable regulations, without prejudice to the consumer's right to handle them only as necessary to determine their nature, characteristics, and functioning.
Products for which legislation establishes an exception are excluded from the right of withdrawal, such as certain personalized products or those made to the consumer's specifications, perishable products, or sealed products that are not suitable for return for health protection or hygiene reasons and have been unsealed after delivery.
Refunds
When the right of withdrawal is legally applicable, the refund will be made within the time limits established by applicable legislation. Kaotiko may withhold the refund until it has received the products or until the customer provides proof of their return, as legally permitted.
As a general rule, the refund will be made using the same payment method used for the purchase, unless the customer expressly accepts a different refund method.
Refunds via Gift Card
When this option is available, the customer may voluntarily choose to receive the amount corresponding to their return via a Kaotiko Gift Card instead of receiving the refund through the original payment method.
The choice of Gift Card will always be optional and will require the customer's express acceptance. The customer may opt for a refund via the original payment method when they have a legal right to do so.
Gift Cards issued as a refund method will be valid for one (1) year from their date of issuance. The expiration date will be communicated to the customer before selecting this refund method and/or at the time of the Gift Card issuance.
Once this period has elapsed, the Gift Card cannot be used, unless applicable regulations establish otherwise.
In the event that Kaotiko offers an additional amount or incentive for voluntarily choosing a refund via Gift Card, the conditions and the corresponding amount will be communicated to the customer before they confirm their choice.
8. Legal guarantee of conformity
Purchased products are covered by the legal guarantee of conformity provided for in current Spanish and European consumer protection legislation at all times.
In case of lack of conformity, the consumer will have the right to the remedies provided for by law.
9. Complaints and customer service
The customer may address any query, incident, or complaint to Kaotiko through the customer service channels indicated on the website.
Kaotiko will process complaints in accordance with the applicable regulations regarding consumers and users.
10. Applicable law and jurisdiction
These General Terms and Conditions of Sale are governed by Spanish law, without prejudice to the rights that may correspond to the consumer according to the mandatory regulations applicable in their country of residence.
Any dispute will be submitted to the competent courts and tribunals in accordance with consumer and user protection regulations.
11. Out-of-court dispute resolution
Where applicable, the consumer may resort to the alternative dispute resolution mechanisms in consumer matters provided for by current legislation.
12. Discount coupons
The codes APP15 and BIENVENIDO10 are intended for new customers and apply only to products that meet the conditions of the promotion.
Unless expressly stated otherwise, these codes cannot be combined with other promotions, offers, or discounts.
Kaotiko may establish specific conditions, validity dates, exclusions, and other requirements for its promotions, which will be communicated to the customer in each case.
